Please read these Terms and Conditions ("Terms") carefully before booking or participating in any In One Heart offering. These Terms form a legally binding agreement between you and In One Heart ("Company," "we," "us," or "our"). By submitting an application, completing a booking, or participating in any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use our Services.

1. Services

In One Heart offers transformational retreats, workshops, group programmes, and private sessions incorporating modalities that may include, but are not limited to, breathwork, somatic movement, energy healing, meditation, sacred ceremony, and related practices (collectively, "Services"). Our Services are experiential and educational in nature. They are not medical treatment, clinical psychotherapy, psychiatry, or a substitute for professional healthcare of any kind. Nothing communicated by In One Heart or its facilitators — verbally, in writing, or through any other medium — constitutes medical advice, diagnosis, or treatment.

2. Eligibility

  • You must be at least 18 years of age to purchase or participate in any In One Heart Service.
  • You must complete an honest, accurate, and complete application or intake form, including full disclosure of any physical health conditions, mental health history, medications, substances, or other circumstances that may affect your participation.
  • You represent and warrant that the information you provide to us is truthful and accurate. Providing false or incomplete information may result in immediate removal from an event without refund.
  • We reserve the right to decline any application, cancel any booking, or remove any participant at our sole and reasonable discretion, including where we believe participation is not appropriate or safe for a given individual. In such cases, we will issue a refund per our Refund Policy.

3. Medical Disclaimer and Assumption of Risk

PLEASE READ THIS SECTION CAREFULLY. IT CONTAINS AN ASSUMPTION OF RISK AND LIMITATION OF LIABILITY.

In One Heart's Services may involve physically and emotionally intensive activities. By booking or participating, you acknowledge and agree to the following:

  • You are voluntarily choosing to participate in In One Heart's Services with full knowledge that these activities carry inherent risks, including physical injury, emotional discomfort, psychological distress, or exacerbation of pre-existing conditions.
  • You have consulted with a qualified physician, mental health professional, or other appropriate healthcare provider if you have any condition that may be relevant to participation, and you have been medically cleared to participate.
  • You understand that breathwork, somatic practices, and ceremonial activities can produce altered or heightened states of consciousness, emotional release, or physical sensations. You accept full responsibility for your own physical, emotional, and psychological wellbeing during and after the Services.
  • You agree to follow all safety instructions provided by In One Heart's facilitation team and to immediately notify a facilitator if you feel unsafe or unwell.
  • You knowingly and voluntarily assume all risks associated with participation in the Services, whether known or unknown at the time of booking.

If you are currently experiencing a psychiatric crisis, active suicidal ideation, active psychosis, or are in an acute mental health episode, we ask that you not participate and that you seek appropriate professional care.

4. Release of Liability and Indemnification

To the fullest extent permitted by applicable law:

a. Release of Liability: You, on behalf of yourself and your heirs, personal representatives, and assigns, hereby release, waive, discharge, and covenant not to sue In One Heart, its owners, directors, officers, employees, contractors, facilitators, agents, and affiliates (collectively, "Released Parties") from any and all claims, damages, demands, losses, liabilities, costs, or expenses of any nature whatsoever, whether known or unknown, arising out of or related to your participation in the Services, including but not limited to claims arising from the negligence of the Released Parties, except in cases of gross negligence or intentional misconduct.

b. Indemnification: You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (i) your use of the Services; (ii) your violation of these Terms; (iii) any false or misleading information you provide; or (iv) your violation of any rights of a third party.

5. Bookings and Payment

  • All prices are displayed in US Dollars (USD) unless otherwise stated.
  • Payment is processed securely through Stripe, Inc. and/or PayPal, Inc. By completing a payment, you agree to the applicable processor's terms of service.
  • A booking is confirmed only upon receipt of full payment or an expressly agreed deposit amount.
  • We reserve the right to correct pricing errors at any time. If a pricing error affects your booking, we will contact you before processing your payment or offer a full refund if payment has already been taken.
  • Deposits are non-refundable unless otherwise expressly stated in the specific offering details or our Refund Policy.

6. Cancellations

Participant cancellations and refunds are governed exclusively by our Refund Policy, which is incorporated into these Terms by reference. Please read it carefully before booking. You acknowledge that the refund schedule reflects the real costs and commitments we make upon confirming your space.

7. Cancellation, Modification, or Postponement by In One Heart

We reserve the right to cancel, reschedule, or materially modify any offering due to insufficient enrolment, facilitator unavailability, weather, force majeure, government restriction, or other circumstances within or beyond our control. In such cases:

  • Cancellation by us: You will receive a full refund of all amounts paid, including any non-refundable deposit. This is your sole remedy.
  • Rescheduling by us: You will be given the option to transfer to the new date at no cost, or receive a full refund.
  • We are not liable for any costs you have independently incurred, including airfare, accommodation, ground transportation, visa fees, or any other travel or preparatory expenses. We strongly encourage you to purchase travel insurance for international and destination retreats.

8. Force Majeure

Neither party shall be liable for failure or delay in performance arising from circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, pandemics, governmental actions, war, terrorism, civil unrest, or failure of third-party infrastructure. If a force majeure event prevents us from delivering an offering, we will offer participants a credit, transfer, or refund at our reasonable discretion.

9. Code of Conduct

Participation in our Services requires mutual respect and commitment to a safe collective environment. You agree:

  • Not to attend any event under the influence of alcohol or unauthorised substances unless explicitly communicated otherwise in advance.
  • To treat all facilitators, staff, and fellow participants with dignity and respect.
  • Not to engage in behaviour that is harassing, threatening, discriminatory, or disruptive.
  • To honour the confidentiality of other participants by not sharing, recording, or disclosing the personal experiences or disclosures of other attendees outside the event container.

We reserve the right to remove any participant from an event for violating this Code of Conduct without refund.

10. Photography, Video, and Media

We may photograph or record aspects of our retreats and events for documentation and promotional use. By participating in an event, you grant In One Heart a non-exclusive, royalty-free, perpetual licence to use your name, likeness, image, and voice in photographs or recordings taken at the event, for marketing and promotional purposes across any media, including digital.

If you do not consent to being photographed or recorded, you must notify us in writing at hello@inoneheart.com no later than 7 days before the event. We will make reasonable efforts to accommodate your request. You may not photograph, video-record, or audio-record other participants without their express consent.

11. Testimonials — FTC Disclosure

Testimonials displayed on our website reflect the genuine experiences of individual participants. Results are not typical and are not a guarantee of outcomes. Individual results will vary based on many factors. Any testimonials featuring specific results are presented as individual accounts only, and In One Heart does not represent or warrant that you will achieve similar results. Where facilitators or participants have a material connection to In One Heart, this is disclosed in accordance with FTC guidelines.

12. Intellectual Property

All content on this Site — including text, images, graphics, logos, course materials, audio, and video — is the sole intellectual property of In One Heart or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, redistribute, publish, modify, create derivative works from, or otherwise use any Site content for any commercial purpose without our express prior written permission. Personal, non-commercial use of site content for the sole purpose of viewing is permitted.

13. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE ACCESS. WE DO NOT WARRANT THAT THE SITE WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN ONE HEART AND ITS RELEASED PARTIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CAUSE OF ACTION ARISING UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US FOR THE SPECIFIC OFFERING GIVING RISE TO THE CLAIM IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow exclusion of certain warranties or limitation of liability for certain types of damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

15. Dispute Resolution — Arbitration Agreement

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

a. Informal Resolution: Before initiating any formal legal proceeding, you agree to contact us at hello@inoneheart.com and attempt to resolve the dispute informally. We will make good-faith efforts to resolve any issue within 30 days of receiving written notice.

b. Binding Arbitration: If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

c. Class Action Waiver: YOU AND IN ONE HEART AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR OUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims.

d. Exceptions: Either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration. Nothing in this section limits your right to file a complaint with applicable regulatory agencies.

16. Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the United States and the State of New York, without regard to its conflict of law principles. Any claims not subject to arbitration shall be brought exclusively in the state or federal courts located in New York, and you hereby consent to the personal jurisdiction and venue of such courts.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and In One Heart with respect to the subject matter hereof and supersede all prior or contemporaneous agreements, representations, warranties, and understandings, whether written or oral.

19. Changes to These Terms

We reserve the right to update or modify these Terms at any time. The updated Terms will be effective upon posting to this page with a revised "Last updated" date. For material changes, we will provide notice via email or a prominent notice on the Site. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
